Terms of Service

These Terms of Service ("Terms") govern your access to and use of OxyDance Pilot ("Service"), operated by OxyDance ("we", "us", or "our"). By accessing or using the Service, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them.

If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms, and references to "you" will include that entity.

OxyDance Pilot is an AI-powered WordPress plugin that extends Breakdance Builder and Oxygen Builder with advanced design automation and AI-assisted section generation. The Service allows users to describe layouts in natural language or upload design references and receive structured native builder elements — without manual configuration.

The Service includes:

• A WordPress plugin that integrates directly into Breakdance Builder and Oxygen Builder
• AI generation powered by the AI model of your choice using your own API key
• License management and usage tracking via your online dashboard
• Access to future updates and improvements as part of your active subscription or lifetime plan

Important: OxyDance Pilot requires an active Breakdance Builder or Oxygen Builder license to function. We are not affiliated with, endorsed by, or sponsored by those products or their respective owners.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

To use OxyDance Pilot, you must create an account. You are responsible for:

• Providing accurate, current, and complete information during registration
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access at [email protected]

We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or have been inactive for an extended period.

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the OxyDance Pilot plugin on the number of WordPress sites permitted by your plan
• Use the AI generation features within your plan's usage limits
• Use and modify the generated builder elements for your own projects

All content generated through OxyDance Pilot using your AI API key is owned by you. The OxyDance Pilot software, brand, documentation, and all associated intellectual property remain the exclusive property of OxyDance.

You may not copy, modify, distribute, sell, or lease any part of the Service itself, nor may you reverse engineer or attempt to extract the source code of the plugin, except as permitted by applicable law.

Certain features of the Service require payment. All prices are displayed in USD and are exclusive of applicable taxes unless stated otherwise.

• The Free plan grants 3 AI generations at no cost — no payment method required
• Yearly subscription plans (Pro Yearly, Agency Yearly) are billed annually in advance and renew automatically
• Lifetime deals (LTD) are one-time purchases that grant perpetual access to the features included at time of purchase
• You authorize us to charge your payment method on file for all subscription fees
• Failed payments may result in suspension of your account and access to the Service

We use Polar as our payment processor. By providing payment information, you also agree to Polar's terms of service.

OxyDance Pilot does not include any AI credits or pre-paid AI usage in any plan. All AI generation features require you to provide your own API key from a supported AI provider (such as Anthropic, OpenAI, Google, xAI, or DeepSeek). This applies to every plan, including paid subscriptions and lifetime deals.

Critical information for all users:

• You are solely responsible for obtaining and managing your own AI API keys
• Your API keys are stored securely on your own WordPress website — we never have access to them and cannot view or retrieve them
• All AI requests are made directly from your WordPress installation to your chosen AI provider — we never see, intercept, or proxy those requests
• All generated results (sections, layouts, code) are saved in your own WordPress database — we do not have access to your generated content
• You pay your AI provider directly for all API usage — this cost is entirely separate from your OxyDance Pilot subscription
• API costs can vary significantly based on your usage and the AI model you choose
• You must comply with your AI provider's terms of service at all times
• We are not responsible for API costs, rate limits, service availability, or billing issues from any third-party AI provider

The Free plan grants 3 AI generation uses at no cost. After exhausting your free uses, you must subscribe to a paid plan to continue using AI generation features. Paid plans provide unlimited AI generations, subject to your AI provider's own rate limits and availability.

You agree not to use the Service to:

• Generate content that is illegal, harmful, defamatory, or infringes third-party rights
• Attempt to circumvent license key restrictions or usage limits
• Share, resell, or sublicense access to the Service to third parties
• Use automated scripts to abuse or overload the Service's infrastructure
• Probe, scan, or test the vulnerability of any OxyDance system
• Impersonate OxyDance or misrepresent your affiliation with us
• Violate any applicable laws or regulations

Violation of these restrictions may result in immediate account termination without refund.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

• We do not warrant that the Service will be uninterrupted, error-free, or free of defects
• AI-generated content may contain inaccuracies and should be reviewed before use in production
• The quality of AI generation depends entirely on the AI model and API key you provide
• We are not responsible for the output quality, availability, or cost of any third-party AI provider
• Third-party integrations (Breakdance Builder, Oxygen Builder, WordPress) may change in ways that affect compatibility

To the maximum extent permitted by law, OxyDance and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Service.

Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the greater of the amount you paid us in the twelve months preceding the claim.

We are not liable for any costs incurred with your AI provider, including API usage charges, rate limiting, or service outages.

You may terminate your account at any time by cancelling your subscription through the dashboard or contacting us at [email protected].

We may suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so, including sections on intellectual property, liability, and governing law.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the date at the top of this page and, where appropriate, by email.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any dispute arising under these Terms shall be resolved through good-faith negotiation. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction.
